Terms and Conditions of Sale
The Terms and Conditions set out below apply to all transactions on the OMM website. Please read through these carefully before placing your order. We may change these terms from time to time without notice to you. Changes will apply to any orders received after the Terms and Conditions change.

Description of Goods
We sell light weight clothing, light weight waterproof clothing, light weight rucksacks and light weight sleeping bags and accessories and are designed for Mountain Marathons and are suitable for use by runners. We also sell event entries and extras for our events.

Prices
The price you pay is the price displayed on this website at the time we receive your order, the prices are inclusive of UK VAT as appropriate. Errors and Omissions are excluded, i.e. we reserve the right not to send an item if we make a pricing error, in this event we will inform you of this as soon as we possibly can.

Purchase and Delivery
To purchase from us you must be over 18 years of age. We pride ourselves on our rapid order fulfilment capabilities and aim to deliver all orders within 5 working days. Payment will be taken at the point of purchase. Delays are occasionally inevitable due to circumstances beyond our control. If you have not received the goods within 14 days of expected delivery, then you will be notified by email or phone and given the opportunity to cancel the contract. Goods are subject to availability. If we are unable to supply the goods, we will inform you of this as soon as we possibly can.

Delivery Costs
Orders above £50 are sold with postage and packing included. A small postage charge will be added to orders less than £50. Goods will usually be sent using a signed-for service by UPS, Parcelforce or Royal Mail.

Delivery Times
Standard dispatch from ordering will be within 5 working days. 1st Class items may take 1-3 working days to be delivered, although the majority (75%) arrives next working day. Please allow up 5 working days for deliveries outside of the UK. Items sent outside of the UK are not considered ‘lost’ until 14 working days after dispatch. ​

All deliveries are sent signed for; therefore, we are unable leave parcels in locations where a signature cannot be provided (e.g the garage). If you will not be in, please use an alternative address, to ensure that your goods can be signed for and delivered.

Payment
Payments are processed by STRIPE. We will take all reasonable precautions to keep the transaction secure. We cannot be held liable for any losses caused by security problems outside our control. If we have reason to suspect that your details have been obtained fraudulently, we will endeavour to let you know as soon as we can.

Please note, your card will be charged at time of placing an order. This secures your order on our system and allows our system to go through its fraud screening processes.

Faulty Goods / Incomplete on Arrival
When you buy goods from a business, in law you have a number of rights as a consumer. To facilitate this, we will need to obtain evidence that goods are faulty.

We may ask for you to email a photo of the fault, and/or ask for goods to be returned. We check returned items, and if a returned item is found not to be faulty we will return the item to you, in this instance you will be liable for the return carriage. Once we have verified the fault, we will issue either refund, replacement or offer a suitable alternative.

Non-fault Returns and Refunds
In addition to your legal rights, we also allow you to return goods if you simply change your mind within 14 days, so long as you ensure:

  1. item is in the original packaging
  2. all the tags are attached
  3. the item has never been worn
  4. you include some paperwork to easily identify that you sent it

Returning items is at your own expense. We shall only refund what you paid for the item alone. It is your statutory duty to take reasonable care of the goods while in your care and while returning them.

Warranty

All goods are sold with warranty according to your statutory rights, which apply for the original purchaser only. Any claims on warranty require proof of purchase. Please contact sales@theomm.com if you have any queries.

Data Protection
The Data Protection Act 2018 applies. You may write to the data controller at our place of business in order to query what data is held about you.

Complaints
We take complaints very seriously. If you feel that we really have fallen short of your expectations, please mail us on sales@theomm.com and we will listen to what you have to say and respond within 14 days.

OMM Ltd. contracts the supply of goods to local distributors.

Legal Dispute Resolution
The contract between us shall be governed by the laws of England and any dispute between us will be resolved exclusively in the courts of England.
